A court spokeswoman revealed today that Florida judge James H. Seals issued an “emergency” pick up order for Mindy McCready‘s 5-year-old son Zander, according to CNN. The troubled country singer took her son from her father’s Florida home earlier this week, though she does not have legal custody of him.

McCready was told to return Zander by 4PM Thursday, and when she did not comply, her son became an official missing person, according to Aimee McLaughlin, a spokeswoman for the Children’s Network of Southwest Florida. Even with the court involvement, McCready has not been officially charged with a crime. The order just grants law enforcement officers the right to take custody of Zander, regardless of whether he is in the state of Florida or not.

“Ms. McCready’s number one priority has always been, and continues to be, the safety of her son,” said her publicist, Kat Atwood, in a recent statement. Atwood urged that McCready “has not been charged with illegal wrongdoing,” adding that the ‘Ten Thousand Angels’ singer has been concerned for her son’s safety and subsequently asked the court to have him returned to her.

In addition to the legal battles over McCready’s son, this week news broke that she is also seven months pregnant with twins. During the past few years, it has been public knowledge that she has waged war with a drug addiction.
