Atlantic City, New Jersey Mayor Marty Small may get the last laugh versus Atlantic County Prosecutor Will Reynolds — as Small now goes from the hunted to the hunter.
Tort Claim Notice Has Been Filed
This is a major, new development and one that we had long predicted would occur.
We have confirmed that attorney Jordan Barbone has filed a tort claim notice on Thursday, March 5, 2026 in the 3:00 p.m. hour.
We have also confirmed that the legendary Ed Jacobs and Lou Barbone, Jordan‘s father will all be working the case versus the Atlantic County defendants.
The tort claims notice names:
- Atlantic County Prosecutor Will Reynolds
- Atlantic County Executive Dennis Levinson
- The County of Atlantic
Barbone filed the tort claim notice today on behalf his clients:
- Atlantic City Mayor Marty Small
- Atlantic City Superintendent of Pubkic Schools — La Quetta Small
- Atlantic City High School Principal — Constance Days-Chapman
Before you can file a lawsuit versus a government entity in New Jersey … The filing of a tort claim notice is the first required step.
Barbone Demolished The Atlantic County Prosecutor’s Office At Trial
Mayor Small overwhelmingly won a not guilty verdict a few days before Christmas, 2025.
The verdict was self-evident to the extent that the Atlantic County Prosecutor’s Office promptly moved to dismiss all charges against La’Quetta Small and Constance Days-Chapman.
Atlantic County Executuve Dennis Levinson
Levinson has been here before. A number of years ago, Levinson observed a former Atlantic County Prosecutor bring forward a very bad case against an Atlantic City Police Officer, James Andros.
The Atlantic County Prosecutor lost this case badly and it cost the taxpayers of Atlantic County millions of dollars … in addition to all of the investigatory and trial costs associated with the bad case.
History may repeat itself as the Small — Small & Days-Chapman taxpayer financial exposure may far exceed the Andros case.
Dennis Levinson Does Not Hold Back
Levinson knew that this was coming and in fairness, he tried to bail Will Reynolds out here. He offered great coaching that could’ve mitigated what’s about to unfold.
I just spoke with Levinson who told me:
The prosecutor is appointed by the governor at the request of the state senator. It is called senatorial courtesy. The taxpayer has no control over the appointment. All the taxpayer does is pay the salaries of the prosecutor, his staff, automobiles etc.. The local taxpayer is also on the hook for all lawsuits not the state of New Jersey. Some system, huh? There are four constitutional officers in each county, the sheriff, the clerk, the surrogate and the prosecutor. The sheriff, the clerk and the surrogate are elected countywide not appointed. The prosecutor is appointed. The people have no say. Only the senator! Senatorial courtesy is archaic as Home rule, said Levinson.
